Course Bookings & Return Policy

1. Australian Consumer Law Rights (ACL)

Under the ACL, consumers are entitled to services that are:

  • provided with due care and skill,

  • fit for the intended purpose, and

  • supplied within a reasonable time.

If we fail to meet these guarantees, you may be entitled to a remedy such as resupply or a refund.

However, the ACL does not require businesses to provide a refund if:

  • you change your mind,

  • you misread course requirements,

  • you fail to attend,

  • you provide incorrect or incomplete information,

  • you are unable to complete the course for personal reasons, or

  • you do not meet the medical or physical prerequisites.

This policy explains how CWD applies these rights in a diving-services context.

2. Prerequisites & Student Responsibilities

All students must meet the following requirements before and during training:

  • Minimum age: 12 years.

  • Swimming ability: Able to swim 200m nonstop and tread water for 10 minutes.

  • Medical fitness to dive, as outlined in our medical statement.

  • Completion of all required PADI course paperwork via the PADI Portal.

Failure to meet these prerequisites is not considered a service defect and is not grounds for a refund.

3. Medical Requirements & Non-Clearance

We strongly encourage reviewing our medical statement before booking.
If you answer “Yes” to any medical questions, you may require a Recreational Dive Medical from a GP.

If you cannot obtain medical clearance before the course begins:

  • You may request rescheduling in accordance with the standard transfer rules.

  • Refunds may be limited to unissued eLearning fees only (see Section 4).

  • Once the course has commenced, no refunds or credits are available for medical non-clearance.

4. Refunds for Course Cancellations

Refund rules are based on your cancellation timeframe:

4.1 Cancellations more than 14 days before course start

  • You will be refunded course fees minus the cost of PADI eLearning materials already issued.

  • eLearning codes are non-refundable and non-transferable.

4.2 Cancellations within 14 days of course start

  • The full cost of the course is forfeited.

​

4.3 Cancellations after course commencement

  • No refunds are provided under any circumstances.

5. Course Transfers (Date / Student / Booking Changes)

PADI eLearning materials are assigned to individuals and are non-transferable.

Date changes are allowed:

  • Free of charge more than 14 days before the course start date.

  • $100 fee if requested within 14 days.

  • $200 fee if requested within 7 days.

Student changes are not permitted once eLearning has been assigned.

6. No-Shows, Late Arrival & Failure to Complete

You are responsible for attending all scheduled sessions (pool, theory, and ocean).

Refunds or credits will not be provided if you:

  • fail to attend,

  • arrive late and cannot participate,

  • cannot complete eLearning on time,

  • voluntarily withdraw,

  • fail performance requirements, or

  • exceed the course timeframe.

Additional training or remediation sessions may be offered at additional cost.

7. Weather, Ocean Conditions & Operational Changes (CWD-Initiated Changes)

Safety is our highest priority. We may reschedule sessions due to:

  • unsafe ocean conditions,

  • equipment or facility issues,

  • instructor availability, or

  • other operational requirements.

Where CWD reschedules:

  • You will be offered an alternative date at no additional cost.

  • Refunds are only provided if a service cannot reasonably be supplied, as required under ACL.

8. PADI Course Certification

PADI courses are performance-based.
You are paying for training, not the certification card.
Certification is earned by meeting required performance standards under instructor guidance.

Failure to meet performance requirements is not grounds for a refund.

9. Remedies for Service Defects

If you believe a service was not delivered with due care, skill, or within a reasonable timeframe, please notify us as soon as possible. We will assess whether:

  • the service can be re-supplied,

  • additional training can be offered, or

  • another ACL remedy applies.

Where eligible, refunds are processed to the original payment method.

  • Course booked and date

  • Description of issue

  • Supporting documents (e.g., medical certificate)

We will respond within 7 business days.
